Acceptance of Terms
By using the MarineHelper.com service (hereinafter the "Platform"), you confirm that you have fully read these Terms of Use and unconditionally and fully accept them. If you do not agree with any provisions of these Terms, please stop using the Platform.
1. General Provisions
1.1 Definitions
- Platform – The MarineHelper.com website, including all its pages, sub-platforms, mobile apps (if any), and other related resources.
- User – A natural person using the Platform for the purposes of job search, obtaining consultations, creating a seafarer profile or other professional information.
- Company – A legal entity or individual entrepreneur that may post vacancies, information about itself on the Platform and interact with Users (crewing agency, maritime organization, training center, documents company, etc.).
- Service – The set of services and functionalities provided by the Platform (including job search, posting and applying to vacancies, maintaining a professional profile, communication with potential employers).
1.2 Subject matter of the agreement
- Providing a platform for job search The Platform provides Users (seafarers) with tools to create a profile, display professional information, and search for vacancies posted by the Company.
- Posting vacancies by companies Companies may publish vacancies and other information to attract potential candidates (Users).
- Creation of profiles of maritime professionals Users may create detailed profiles including personal and professional data, resume, certificates and other relevant information.
2. Registration and account
2.1 Registration process
- Data requirements During registration, the User is obliged to provide reliable personal data, including but not limited to: full name, a valid email address, phone number (if necessary), as well as other information that may be required for full use of the Service.
- Verification of information The Platform may conduct selective or systematic verification of the provided data (e.g., email address verification) to ensure their reliability and minimize the risk of fraud.
- Email verification To activate the account, email address verification may be required. The verification link is sent automatically after the User enters the email.
2.2 User obligations
- Accuracy of information The User guarantees that all information provided by them during registration and/or in the process of using the Platform is accurate, up-to-date, and not misleading.
- Currency of data The User undertakes to timely update their data (e.g., if contacts, place of work or qualifications change) so that the Platform can correctly provide services.
- Account security The User bears personal responsibility for the confidentiality of their login and password, as well as for all actions performed under their credentials. It is recommended to use strong passwords and not to share them with third parties.
3. Rules of Use
3.1 Permitted Use
- Job search The User may use the Service’s tools to search for suitable vacancies, view information about companies, and apply to interested offers.
- Posting vacancies Companies may post vacancies and related information to give Users an idea of the nature of the work, conditions, and requirements for candidates.
- Communication with companies The Platform provides opportunities for direct communication with potential employers or partners: sending messages, responses, receiving feedback on the status of the application, etc.
3.2 Prohibited actions
- Spam and fraud It is prohibited to send unsolicited messages, duplicate postings, and any fraudulent activity (including phishing, using someone else’s data, etc.).
- False information It is not allowed to post knowingly false information about oneself, one’s skills, education, work experience, etc., with the purpose of misleading Companies or other Users.
- Violation of others' rights It is prohibited to publish materials containing personal data of third parties without their consent, as well as any materials that infringe copyrights and other rights.
4. Rights and obligations
4.1 Platform rights
- Content moderation The Platform reserves the right to review and edit (or delete) any content posted by Users and Companies if that content contradicts these Terms, applicable law, or is misleading.
- Blocking violators The Platform may suspend or block access for a User or Company violating these Terms (for example, for posting illegal content, fraudulent vacancies, etc.).
- Modification of functionality The Platform may at any time make changes, add new features or restrict access to existing features, and, where possible, notify Users about such changes.
4.2 Platform obligations
- Ensuring availability The Platform strives to provide round-the-clock availability of the service, except during maintenance or force majeure.
- Technical support The Platform provides Users and Companies with a channel of communication (email, chat, or contact form) to resolve technical and organizational issues.
- Data protection The Platform commits to comply with the Privacy Policy, apply appropriate personal data protection measures and act in accordance with GDPR and other applicable laws.
5. Intellectual property
5.1 Platform rights
- Trademarks All trademarks, logos, brand names and other objects of intellectual property used on the Platform belong to their rightful owners and are protected by copyright laws.
- Source code The source code, design, architecture of the Platform and other elements related to the software belong to MarineHelper.com and cannot be reproduced or used without permission.
- Design and content The overall design, interfaces, graphical elements, texts and other materials created by the Platform are protected by copyright and may not be copied or distributed without the written consent of MarineHelper.com.
5.2 User rights
- Uploaded materials The User retains copyright to any content (resume, photos, descriptions) that they upload to the Platform. At the same time, the User grants the Platform a non-exclusive license to use and display such content within the Platform’s operation.
- Personal data Personal data provided by the User is processed in accordance with the Privacy Policy and data protection laws.
- Reviews and comments The User may publish reviews, comments, or other materials related to their experience with the Platform, provided that such information is truthful and does not violate the rights of third parties.
6. Liability
6.1 Limitation of liability
- Quality of vacancies The Platform is not responsible for the completeness, timeliness, and accuracy of information about vacancies posted by a Company. Each Company is independently responsible for the content of its publications.
- Actions of companies The Platform is only an intermediary between the User and Companies. All employment relationships, pay arrangements, and other obligations arise directly between the User and the Company. MarineHelper.com is not responsible for the actions or inaction of companies, their internal policies, financial obligations, the quality of offered vacancies, etc.
- Technical failures The Platform does not guarantee absolute faultlessness and uninterrupted operation. In case of unforeseen technical problems or failures we will strive to restore normal operation as soon as possible, but we are not liable for losses or damages caused by interruptions in access.
6.2 User liability
- For information provided The User guarantees that all information they post on the Platform (including personal data, description of experience, resume, etc.) does not violate the rights of third parties and is true.
- For their actions The User is solely responsible for compliance with the law, for the correctness and ethicality of their conduct when interacting with other Users and Companies.
- For breach of the Terms If the User, through their actions, violates these Terms, the law, or causes damage to the Platform and/or third parties, they must compensate such damages in accordance with applicable law.
7. Payments and subscriptions
(This section applies if paid services or subscriptions are provided on the Platform. If the User uses free functionality, some parts may not be applicable.)
7.1 Tariffs
- Price structure Paid services or subscriptions, if provided, may be listed on the relevant pages of the Platform. We strive to provide clear information about the cost and scope of services to avoid ambiguities.
- Subscription periods Paid services may be provided on a monthly, quarterly, yearly basis or under other models. The terms and duration of the subscription are indicated at the time of its purchase.
- Payment methods Payments can be made by bank cards, electronic wallets or other methods supported by the Platform. Transaction security is provided by the payment provider.
7.2 Payment terms
- Automatic renewal Some subscriptions may automatically renew at the end of the paid period, unless otherwise notified. The User can disable auto-renewal in their personal account or by contacting support.
- Cancellation of subscription If desired, the User may terminate the subscription before the end of the paid period in accordance with Platform’s cancellation rules. Funds for unused periods may not be returned, unless otherwise provided by the refund policy.
- Refunds Refund terms (full or partial) are governed by the Platform’s separate refund policy or applicable law. If the User believes they are entitled to a refund, they can contact support with the appropriate request.
8. Privacy
8.1 Data processing
- Under GDPR All personal data provided by the User upon registration and during use of the Platform are processed in accordance with the GDPR provisions (for users from GDPR-applicable countries) and other applicable laws.
- Protection of information The Platform applies technical and organizational security measures to prevent unauthorized access to personal data, their loss or distortion.
- Rights of data subjects The User has rights listed in the Privacy Policy (for example, the right of access, correction, deletion, etc.). Detailed information and the procedure for exercising rights are described in the Privacy Policy (../privacy).
8.2 Security
- Technical measures Encryption of transmitted data (HTTPS), secure servers and regular backups.
- Organizational measures Limiting data access rights, staff training and internal information protection policies.
- Breach notifications In case of data leakage or compromise, the Platform strives to notify affected Users in a reasonable time and in accordance with legal requirements.
9. Changes and termination
9.1 Changes
- Procedure for changes The Platform may unilaterally make changes to these Terms. The current version will be available on the relevant Platform page.
- User notification In case of significant changes that may affect the rights and obligations of Users, the Platform may notify them via email to the address provided during registration or by posting an informational message on the site’s homepage.
- Effective date Changes take effect from the moment of publication, unless another date is specified in the text.
9.2 Termination
- Termination conditions The User may terminate using the Platform at any time by deleting their account or contacting support.
- Consequences of violations In case of significant violations of these Terms, the Platform has the right to block or delete the User’s account without prior notice, as well as restrict access to services.
- Data retention After deleting the account, certain data (e.g., anonymized statistics or archival copies) may continue to be stored in backup systems. Personal data will be deleted or anonymized within a reasonable time if there are no legal grounds for further processing.
10. Dispute resolution
10.1 Resolution procedure
- Pre-trial dispute resolution Before turning to the courts, the User and the Platform should try to settle the dispute through a claim process (e.g., sending a complaint by email and providing a reasonable time to respond).
- Governing law For Users, Companies, and other persons interacting with the Platform, the law of the country of registration of MarineHelper.com applies, unless otherwise provided by mandatory legal norms.
- Jurisdiction All disputes not resolved through the complaint procedure are heard by the court at the place of registration of MarineHelper.com or in another judicial body determined by mutual agreement of the parties and relevant agreements.
