Terms of Use

1. General Provisions

1.1 Definitions

• Platform – the Crewings.me website, including all its pages, sub-platforms, mobile applications (if any), and other related resources.
• User – an individual using the Platform for job search, consultations, posting a seafarer’s profile or other professional information.
• Company – a legal entity or individual entrepreneur who can post job vacancies, information about themselves, and interact with Users (crewing agency, maritime organization, training center, document company, etc.).
• Service – the set of services and functionalities provided by the Platform (including job search, posting and responding to vacancies, maintaining a professional profile, communication with potential employers).

1.2 Subject of Agreement

1. Provision of a job search platform
   The Platform provides Users (seafarers) with tools to create a profile, display professional information, and search for vacancies posted by Companies.
2. Posting vacancies by companies
   Companies may publish vacancies and other information to attract potential candidates (Users).
3. Creation of maritime specialists' profiles
   Users can create detailed profiles including personal and professional data, CVs, certificates, and other relevant information.

2. Registration and Account

2.1 Registration Process

1. Data requirements
   When registering, the User must provide accurate personal data, including but not limited to: full name, valid email address, phone number (if necessary), and other information that may be required for full use of the Service.
2. Information verification
   The Platform may conduct selective or systematic verification of the provided data (e.g., email address verification) to ensure their accuracy and minimize fraud risk.
3. Email confirmation
   Account activation may require email address confirmation. A confirmation link is sent automatically after the User enters their email.

2.2 User Obligations

1. Accuracy of information
   The User guarantees that all information provided during registration and/or while using the Platform is accurate, up-to-date, and not misleading.
2. Data currency
   The User agrees to promptly update their data (e.g., if contacts, workplace, or qualifications change) so the Platform can provide services correctly.
3. Account security
   The User is personally responsible for the confidentiality of their login and password, as well as for all actions performed under their account. It is recommended to use strong passwords and not share them with third parties.

3. Rules of Use

3.1 Permitted Use

1. Job search
   The User may use the Service tools to find suitable vacancies, view company information, and respond to interesting offers.
2. Posting vacancies
   Companies may post vacancies and relevant information giving Users an idea of the nature of work, conditions, and candidate requirements.
3. Communication with companies
   The Platform provides opportunities for direct communication with potential employers or partners: sending messages, responses, receiving feedback on application status, etc.

3.2 Prohibited Actions

1. Spam and fraud
   Sending unsolicited messages, duplicating offers, and any fraudulent activities (including phishing, using others' data, etc.) are prohibited.
2. False information
   Posting knowingly false information about oneself, skills, education, work experience, etc., with the intent to mislead Companies or other Users is not allowed.
3. Violation of others' rights
   Publishing materials containing personal data of third parties without their consent, as well as any materials violating copyright or other rights, is prohibited.

4. Rights and Obligations

4.1 Platform Rights

1. Content moderation
   The Platform reserves the right to review and edit (or delete) any content posted by Users and Companies if such content contradicts these Terms, legislation, or is misleading.
2. Blocking violators
   The Platform may suspend or block access for Users or Companies violating these Terms (e.g., posting illegal content, fraudulent vacancies, etc.).
3. Functionality changes
   The Platform may at any time make changes, add new features, or restrict access to existing features, while, if possible, notifying Users about such changes.

4.2 Platform Obligations

1. Ensuring availability
   The Platform strives to provide round-the-clock service availability, except during technical maintenance or force majeure circumstances.
2. Technical support
   The Platform provides Users and Companies with communication channels (email, chat, or feedback form) for resolving technical and organizational issues.
3. Data protection
   The Platform commits to comply with the Privacy Policy, apply appropriate personal data protection measures, and act in accordance with GDPR and other applicable laws.

5. Intellectual Property

5.1 Platform Rights

1. Trademarks
   All trademarks, logos, trade names, and other intellectual property objects used on the Platform belong to their lawful owners and are protected by copyright law.
2. Source code
   The source code, design, architecture of the Platform, and other software-related elements belong to CrewingsMe LTD and may not be reproduced or used without permission.
3. Design and content
   The overall design, interfaces, graphic elements, texts, and other materials created by the Platform are protected by copyright and may not be copied or distributed without written consent of CrewingsMe LTD.

5.2 User Rights

1. Posted materials
   The User retains copyright on any content (CVs, photos, descriptions) they upload to the Platform. At the same time, the User grants the Platform a non-exclusive license to use and display such content within the Platform’s operation.
2. Personal data
   Personal data provided by the User is processed in accordance with the Privacy Policy and data protection laws.
3. Reviews and comments
   The User may post reviews, comments, or other materials related to their experience with the Platform, provided such information is truthful and does not violate third-party rights.

6. Liability

6.1 Limitation of Liability

1. Vacancy quality
   The Platform is not responsible for the completeness, relevance, and accuracy of vacancy information posted by Companies. Each Company is solely responsible for the content of its postings.
2. Company actions
   The Platform acts only as an intermediary between the User and Companies. All employment relationships, payment agreements, and other obligations arise directly between the User and the Company. CrewingsMe LTD is not responsible for the actions or inactions of companies, their internal policies, financial obligations, vacancy quality, etc.
3. Technical failures
   The Platform does not guarantee absolute error-free and uninterrupted operation. In case of unforeseen technical problems or failures, we will try to restore normal operation as soon as possible but are not liable for losses or damages caused by access interruptions.

6.2 User Liability

1. For provided information
   The User guarantees that all information posted on the Platform (including personal data, experience descriptions, CVs, etc.) does not violate third-party rights and is truthful.
2. For their actions
   The User is solely responsible for complying with laws and for the correctness and ethics of their behavior when interacting with other Users and Companies.
3. For violation of terms
   If the User violates these Terms, laws, or causes damage to the Platform and/or third parties, they must compensate such damages according to applicable law.

7. Payment and Subscriptions

(This section applies if paid services or subscriptions are provided on the Platform. If the User uses free functionality, some points may not be relevant.)

7.1 Tariffs

1. Pricing structure
   Paid services or subscriptions, if available, may be listed on the relevant Platform pages. We strive to provide clear information about costs and service scope to avoid ambiguity.
2. Subscription periods
   Paid services may be offered monthly, quarterly, annually, or under other models. Terms and subscription duration are specified at the time of purchase.
3. Payment methods
   Payment can be made by bank cards, e-wallets, or other methods supported by the Platform. Transaction security is ensured by the payment provider.

7.2 Payment Terms

1. Automatic renewal
   Some subscriptions may automatically renew at the end of the paid period unless otherwise notified. The User can disable auto-renewal in their account or by contacting support.
2. Subscription cancellation
   The User may cancel the subscription before the end of the paid period according to the Platform’s cancellation rules. Funds for unused periods may not be refunded unless otherwise stated in the refund policy.
3. Refunds
   Refund conditions (full or partial) are regulated by the Platform’s refund policy or applicable law. If the User believes they are entitled to a refund, they may contact support with a request.

8. Privacy

8.1 Data Processing

1. According to GDPR
   All personal data provided by the User during registration and use of the Platform is processed in accordance with GDPR provisions (for users from GDPR-applicable countries) and other applicable laws.
2. Information protection
   The Platform applies technical and organizational security measures to prevent unauthorized access, loss, or distortion of personal data.
3. Data subject rights
   The User has rights listed in the Privacy Policy (e.g., access, correction, deletion, etc.). Detailed information and procedures are described in the Privacy Policy.

8.2 Security

1. Technical measures
   Data encryption (HTTPS), secure servers, and regular backups.
2. Organizational measures
   Access rights restrictions, staff training, and internal information protection regulations.
3. Breach notifications
   In case of data leaks or compromises, the Platform strives to notify affected Users within reasonable timeframes and according to legal requirements.

9. Changes and Termination

9.1 Changes to Terms

1. Change procedure
   The Platform may unilaterally amend these Terms. The current version will be available on the relevant Platform page.
2. User notification
   For significant changes affecting Users' rights and obligations, the Platform may notify via email provided at registration or by posting an informational message on the main site page.
3. Effective date
   Changes take effect upon publication unless another date is specified.

9.2 Termination of Use

1. Termination conditions
   The User may stop using the Platform at any time by deleting their account or contacting support.
2. Consequences of violations
   In case of significant violations of these Terms, the Platform may block or delete the User’s account without prior notice and restrict access to services.
3. Data retention
   After account deletion, some data (e.g., anonymized statistics or archival copies) may remain in backup systems. Personal data will be deleted or anonymized within reasonable timeframes unless legal grounds for further processing exist.

10. Dispute Resolution

10.1 Resolution Procedure

1. Pre-trial settlement
   Before going to court, the User and Platform must attempt to resolve disputes through claims procedures (e.g., sending a claim by email and allowing reasonable response time).
2. Applicable law
   For Users, companies, and others interacting with the Platform, the law of the country of registration of CrewingsMe LTD applies unless mandatory legal norms provide otherwise.
3. Jurisdiction
   All disputes unresolved through claims are considered by the court at the place of registration of CrewingsMe LTD or another court agreed upon by the parties and relevant agreements.
